🙋‍♀️WAIVER AND RELEASE

I understand that during the Coaching I may participate in physical activity with yoga stretches and as part of the Coaching.

 

I acknowledge and agree that:

  • I am the person named in this form.

  • I have no health problems or disabilities that would make participation in yoga unwise.

  • I understand my participation is voluntary and that I knowingly assume all inherent risks in yoga including but not limited to any stretching injuries.

 

Thrive Lotus [ABN 24512557548] has endeavoured to maintain the safety of the Coaching Sessions however, we require your co-operation by you agreeing with the following. I agree to:

  • obey all guidelines and safety rules set by Tune in Yoga;

  • alert Thrive Lotus to any inappropriate behaviour; and

  • immediately discontinue participation in the Coaching Session if at any time I believe conditions to be unsafe.


In case of emergency, I authorise Thrive Lotus to secure emergency medical care or transport and seek any medical attention, as necessary. I agree to assume all costs of emergency medical care and transport. In consideration of permission to participate in the Activity, I, and my Representatives [“Releasing Parties”] release Thrive Lotus from all Claims except in relation to gross negligence or omission.


I also agree to indemnify Thrive Lotus from and against any all Loss and Damage arising out of or in connection with my participation.

I am voluntarily signing this agreement, and intend my signature to be a complete release of all liability.

Definitions:

“Claims” means all under statute, tort, contract or negligence, any demand, award, or costs.

“Loss and Damage” includes any direct, indirect, incidental, punitive, special, or consequential loss or damages of any kind, including but not limited to, any personal injury, death, negligence, trespass, property damage and legal costs. 

“Representatives” means yourself, spouse, heirs, parents or guardians, personal representatives, and assigns.


“Thrive Lotus” means Laura Ivonne Hernandez Reyes t/as Thrive Lotus [ABN 95493458235] and includes all its owners, directors, employees, volunteers, independent contractors.
